Why the Strategy Fails at Home

  • Use tax, not sales tax. Most states impose use tax at the same rate as sales tax on vehicles bought out-of-state but used in-state. Buying through a Montana LLC does not change where the vehicle is garaged and used.
  • Registration ≠ situs. The LLC may own the truck, but the tax situs is where the vehicle is habitually garaged. DMV and toll, insurance, and property-tax records place it.
