If you earn on Upwork, Fiverr, TikTok Shop, or as a social media influencer in the Philippines, the Bureau of Internal Revenue's message in 2026 is explicit: register, display your Registration Seal Badge on every store and profile, file monthly, quarterly, and annually, and pay income plus business tax — or face a 50% civil penalty plus potential tax evasion prosecution. An initial 250 influencers have already been probed under RMC 97-2021, and the BIR has reminded the public it can obtain data from foreign treaty partners to verify influencer income without waiting for a local filing.

Here is the 2026 compliance stack for freelancers and influencers.

The Three Registrations That Come First

  • Register with the BIR and get a Certificate of Registration (COR). Every freelancer and influencer is a self-employed business for tax purposes. Registration determines whether you are non-VAT (most freelancers under PHP 3M) or VAT-registered.

  • Display the Registration Seal Badge. Under 2026 guidance, digital economic participants — online sellers, freelancers, professionals, vloggers, influencers — must visibly display the BIR Registration Seal on websites, e-commerce stores, and social media business pages. It is not optional branding; it is proof of registration that the BIR checks.

  • Issue registered invoices/receipts. BIR-registered receipts are required for every collection, with Authority to Print and the seal number traceable.

The Tax Choice — 8% Gross vs. Graduated + Percentage/VAT

Philippine freelancers under PHP 3M who are non-VAT have two income tax paths at registration — an election you make annually:

  • 8% on gross sales/receipts in excess of PHP 250,000. Simple, no business tax (percentage or VAT), but you cannot claim deductions. If you earn PHP 800,000, you pay 8% on PHP 550,000 = PHP 44,000.

  • Graduated rates + business tax. Progressive income tax (0–35%) on net income after deductions, plus either 3% percentage tax (if non-VAT and under PHP 3M) or 12% VAT (if VAT-registered or over PHP 3M). This wins when deductions are substantial.

The election matters on day one — a creator with low expenses often saves with 8%, while a freelancer with significant contractor, equipment, and rent costs often saves with graduated plus deductions.

The Filing Calendar — Monthly, Quarterly, Annually

  • Monthly percentage tax (if non-VAT and graduated): BIR Form 2551Q (formerly 2551M) plus 0605, due the 25th of the following month
  • Quarterly income tax: BIR Form 1701Q, due April 15, August 15, November 15
  • Annual income tax: BIR Form 1701, due April 15
  • Withholding if you pay others: If you pay contractors, the withholding filing obligations apply to you as a withholding agent

Miss one monthly percentage filing and the system generates a delinquency that now accrues until the December 31, 2026 abatement window — a 2026 lifeline for delinquent accounts existing as of December 31, 2025, with basic tax + penalties ≤PHP 80,000 per year, for a flat PHP 5,000 abatement fee paid via 0605 within five working days of acceptance.

RMC 97-2021 states the BIR may rely on data from treaty partners to establish influencer liability and that influencers are advised to voluntarily and truthfully declare income without waiting for a formal investigation — precisely because the BIR can obtain platform data from abroad.
