اگر شما قهوه، آب پرتقال، گوشت گاو یا فلزات خاص از برزیل وارد میکنید، هزینهٔ پایه شما ممکن است درنای ۵۰٪ افزایش یافته باشد — یا، اگر محصول شم در لیست صحه باشد، اصلا افزایش نیافته. در ۳۰ ژوئی، یک فرمان جدید اجرایی تحت قانون بینالمللی قدرتهای اقصادیه اضطرار (IEEPA) یک تعرفهٔ ۴۰٪ بر کالاهای برزیلی افزودهعلاوه بر تعرفهٔ ۱۰٪ موجود، که مجموعاً باعث ۵۰٪ بالاتر از نرخ عادی MFN از ۱۲:۰۱ بامداد از ۶ اگست میشود. فرق بین محصولی که در لیست است و محصولی که نیست به یک ضمیمهٔ واحد، اعفای برای کالاهای که قبلاً تحت بخش ۲۳۲ تکلیف شده، و چگونگی قبولpeur درمنطقهٔ خارجهٔ تجارتی (FTZ) بستگی دارد.

برای یک قهوهساز کوچک که در ماه ۲۰ عدد بستهٔ قهوهٔ خصالی میخرد، یک رستوران زنجیرهٔ تاکو که تکههای گوشت گاو برزیلی تهیه میکند، یا یک مغازهٔ ماشینآلات که آهن خلیق و سیلیکون میخرد، آن ضمیمه یک پاورقی نیست. آن تصمیم میگیرد که آیا شما باید قیمت منوی خود را تغییر بدهید، پروندهٔ خرید را دوباره مذاکره کنید، یا به سادگی با عوامل (بروکر) خود تأیید کنید که کد HTS شمل در لیست استثنای است. در اینجا چگونگی خواندن فرمان، جایی استثناهای واقعی، و چگونه کتابهای شم را به واقعیت جدید بدون مبالغهیا کمبری کهای موجودان یا miss کردن یک برگردی (duty drawback) منعکس کنید.

چه تغییر یافته و چه هنگام اجرایی میشود

این فرمان ساختار ساده دارد ولی اجرای آن لایههای زیاد دارد:

Which Products Are Actually Excluded (and Which Are Not)

In this most small importers either save a lot of money or make a costly error. There are two separate buckets of exclusion, and they are not the same.

Annex I: Products that do not get the new 40%

The Executive Order includes an Annex I list of about 690 tariff lines that are not subject to the additional Brazil 40%. You need the annex with your broker to check your specific 8- or 10-digit HTS, but the headline categories that are out include:

  • Silicon metal and pig iron
  • Civil aircraft, aircraft engines, and certain aircraft parts (think Embraer supply chain)
  • Brazil nuts
  • Orange juice (single-strength and concentrate, 0710HTS 2009.11 and 2009.12) and certain other processed citrus
  • Select energy products (including certain crude and fuel categories) and selected wood pulp and paper goods

For a specialty food importer, the distinction is sharp: orange juice and Brazil nuts are out, so a container of not-from-concentrate orange juice from São Paulo entered on Augat 20 would not pay the extra 40% (it still pays the existing 10% mutual and normal MFN). But green coffee (0901.11/0901.12) is not on Annex I. If you brew Brazilian specialty coffee, that cost increase hits in full.

Beef is the same story. Most fresh, chilled, and frozen beef cuts from Brazil (0102, 0102) are not on Annex I and are therefore subject to the full additional duty. If you buy Brazilian beef trimmings for a restaurant chain, your cost per pound just went up.

Section 232 Official Carve-Out: Goods Already Paying Their Own Tariffs

A separate exclusion says goods already covered by Section 232 tariffs are not double-hit by this Brazil order:

  • Steel and steel products (Section 232, currently 50%)
  • Aluminum (Section 232)
  • Cars and car parts (Section 232)
  • Copper (starting August 1 under parallel Section 232 action)

If you import Brazilian steel or aluminum extrusions, you already paying the Section 232 rate. That excludes them from the Brazil IEEPA addition, so you don't pay 50% + another 50%. It's not a pass—you still pay Section 232 duty—but it avoids a 100% stack. Keep your entry documentation clear on which authority is applied. CBP will expect the correct case number and Chapter 99 subheading for the specific exclusion claim.

A common mistake is assuming steel from Brazil is now duty-free because it's excluded from the Brazil order. It's not. A hot-rolled coil from Brazil entered on August 10 still pays Section 232 steel duty. The exclusion only prevents double duty.

Why Your Bookkeeping Can’t Wait for the Broker's Statement

Brokers collect and remit duties, but your books determine your margin, inventory value, and tax deduction. Recording the tariff correctly in your ledger on the right date is as critical as getting the rate right.

Consider a roaster with a standing PO for 40,000ofgreencoffee(CIF)fromMinasGerais,loadedAugust3,enteredAugust12.Underthetransitexception,thatshipmentisexempt.ThenextPO,loadedAugust9,samevalue,enteredAugust18,isnotexempt.Thefirstshipmentslandedcostisroughly40,000 of green coffee (CIF) from Minas Gerais, loaded August 3, entered August 12. Under the transit exception, that shipment is exempt. The next PO, loaded August 9, same value, entered August 18, is not exempt. The first shipment's landed cost is roughly 40,000 + freight, insurance, existing 10% reciprocal, harbor fees. The second shipment's landed cost is 40,000+same+additional40,000 + same + additional 16,000 (40% of CIF). That $16,000 is a real increase that must appear in inventory or COGS immediately, depending on when you take title.

If you wait for the monthly broker statement, inventory will be misstated for weeks, pricing fails, and your margin report won't tell reality.

Practical Checklist for Small Importers

Use this as a one-week sprint with your broker, 3PL, and bookkeeper.

1. Audit Every Outstanding PO with Brazil as Origin

Create a sheet: PO number, supplier, product description, 8-digit HTS, CIF value, estimated on-board date, estimated entry date, Annex I or Section 232 status, projected extra duty. Sort by entry date, not order date. Anything entering on/after Aug 6 is in scope unless it has exclusion.

Bookkeeper should tag these POs in your system to trace which inventory lots carry the extra duty.

2. Confirm HTS with Attachments

Do not self-classify exclusions from a news headline. Send your broker a list: "0901.11.00 — green coffee, unroasted, decaf — Annex I? Section 232?" Get written per-code answer in email you keep.

For mixed containers, exclusions are line-item specific. A shipment with three HTS lines—orange juice (excluded via Annex I), green coffee (not excluded), steel fittings (Section 232 excluded) will have one line at 10%+MFN, one at 50%+MFN, and one at the Section 232 rate. Your entry summary will show different Chapter 99 numbers per line.

3. Lock transit exception paperwork now

For people destined before Aug 6, with entry by Oct 5: collect through B/L showing on-board date, commercial invoice, packing list, draft entry summary. Put in a single folder per shipment. If CBP asks proof months later, you won't be searching emails.

4. Determine FTZ status before admission

If you operate an FTZ, confirm with zone operator: Brazil-origin ADS as of 06/08 are privileged foreign for status unless.

5. Recalculate landed cost and reprice

Create a temporary tariff addition column in your cost sheet for Brazil-origin items. Example SKU: CIF 10,freight10, freight 0.30, insurance $0.17:

  • Pre-Aug 6: 10.47+1010.47 + 10% = 1.047 + MFN/fees
  • Post-Aug 6, not excluded: 10.47+5010.47 + 50% extra (5.235) + same MFN/fees

That's 40% step up. Model both scenarios to see how price change, pack size, or switching supplier (to Colombia, Ethry) restores margin.

6. Record duty liability on the correct day

For goods where 项目 take title at loading (FOB origin), the tariff still at entry, not at PO/date. That creates mismatch: you owe supplier now, CBP later. In ledger, keep PO in in-transit inventory and create separate entry for duty when entry happens.

Ledger entry example:

If goods are still in warehouse not expensed, capitalize the tariff into inventory instead of COGS, using Assets:Inventory:Coffee. Entry debits Assets:Inventory vs Expenses:COGS until you roast and sell.

7. Track duty drawback as a receivable

If you re-export finished goods with Brazilian inputs, set up a drawback claim tracker on the day you pay duty. Each export that qualifies should generate a receivable for recoverable amount, with manufacturing evidence, export bills, entry numbers. Receivable reminds you to act.

8. Keep row for 5 years, not 5 weeks

CBP audits classifications and exemptions after the fact. Keep Annex I printout with HTS circled, broker's written confirmation, B/L, entry summary (7501), FTZ admission records per entry number. Use a PDF per entity.

If an importer can hand over packet, audit is far easier.

How to Talk to Customers and Suppliers Without Overcommitting

The order explicitly allows rates to change both ways. Don’t write your customers that 50% is forever, or that You cancel suppliers. Use this script:

"The U.S. introduced 40% tariff on most Brazilian goods from Aug 6, on top of 50% import tax. Orange juice, nuts, and pig iron are exempt via Annex I, and steel/aluminum already pay Section 232 plus. Coffee and beef are not excluded, they pay 50% expecting if loaded before Aug 6 and entered by Oct 5. We’re reviewing our POs and adjust pricing once we confirm entry dates with our broker."

That’s accurate, narrow, and flexible if the annex changes or Brazil negotiates.
